REFUND AND CANCELATION POLICY
This Refund & Cancellation Policy (“Policy”) forms an integral part of the Terms & Conditions and Privacy Policy of Roamie Mobility LLP (“Roamie”, “we”, “our”, “us”) and governs cancellations and refunds in respect of bookings made through the Platform. These Terms & Conditions shall be read together with the Privacy Policy and the Refund & Cancellation Policy.
1. Roamie operates as a technology platform and facilitator enabling users to discover, book and pay for transportation and travel-related services offered by third-party service providers such as bus operators, transporters, or other vendors (“Service Providers”). Roamie does not operate or control the services provided by Service Providers and does not determine fares, availability, cancellation eligibility or refund amounts, except to the limited extent expressly stated herein.
2. Cancellations by users are permitted only if and to the extent allowed under the cancellation policy of the relevant Service Provider. The availability of cancellation, applicable charges, cut-off times and refund eligibility are determined solely by the Service Provider and may vary depending on the service, route, fare type and time of cancellation.
3. If a cancellation is permitted and successfully processed, the refund amount (if any) shall be calculated strictly in accordance with the Service Provider’s applicable cancellation and refund rules, after deduction of:
- cancellation charges imposed by the Service Provider;
- applicable taxes; and
- any non-refundable components as specified at the time of booking.
Roamie does not guarantee any minimum refund amount.
For the avoidance of doubt, any platform fees, convenience fees, service charges, technology charges, transaction fees or similar amounts collected by Roamie for facilitation of the booking are separate from the Base Fare charged by the Service Provider.
Unless expressly stated otherwise at the time of booking or required under applicable law, such charges are non-refundable, irrespective of whether the Base Fare or any portion thereof is refunded by the Service Provider.
Where applicable, any transaction fee or booking commission charged by Roamie for facilitation of the booking shall be deemed earned upon successful booking and shall not be refundable merely on account of subsequent cancellation of the ticket.
4. Approved refunds shall be processed to the original mode of payment used for the booking. The time taken for the refund to reflect in the user’s account may vary depending on the payment method, bank or payment gateway and is typically subject to timelines prescribed by such third parties. Roamie shall not be liable for delays attributable to banks, payment gateways or Service Providers.
5. No refund shall be available in the following circumstances:
- where the Service Provider’s policy does not permit cancellation or refund;
- no-show or failure to avail the service;
- partial utilisation of the service;
- promotional, discounted or special fares marked as non-refundable;
- incorrect or incomplete information provided by the user at the time of booking;
- cancellation requests made after the cut-off time specified by the Service Provider.
6. In the event a service is cancelled, rescheduled or materially modified by the Service Provider:
- Roamie shall facilitate communication between the user and the Service Provider;
- refunds or alternative arrangements, if any, shall be governed by the Service Provider’s policy;
- Roamie’s role shall be limited to processing refunds or adjustments as received from the Service Provider.
Any obligation to refund the Base Fare or any statutory compensation in respect of the transport service shall vest solely with the Service Provider, and Roamie shall have no independent liability in this regard. Roamie does not assume liability for losses, inconvenience or damages arising from actions or omissions of Service Providers.
7. No refunds shall be guaranteed where cancellation or non-performance of services occurs due to force majeure events including but not limited to natural disasters, strikes, government actions, technical failures, or circumstances beyond the reasonable control of Roamie or the Service Provider. Any refund in such cases shall be subject to the Service Provider’s applicable policy.
8. Roamie’s responsibility in relation to cancellations and refunds is limited to:
- facilitating the request raised by the user;
- transmitting the request to the relevant Service Provider; and
- processing refunds received from the Service Provider.
Roamie shall not be liable for denial of refunds, quantum of refunds, or delays caused by Service Providers, banks or payment gateways, except to the extent mandated under applicable law.
9. To the maximum extent permitted under applicable law and subject to the Limitation of Liability provisions contained in the Terms & Conditions, Roamie Mobility LLP (“Roamie”) shall not be liable for any indirect, incidental, consequential, special, punitive or exemplary damages, including but not limited to loss of profit, loss of business, loss of data, loss of goodwill, or any other economic or reputational loss, arising out of or in connection with cancellations, refunds, or use of the Platform in relation thereto, even if Roamie has been advised of the possibility of such damages.
10. Without prejudice to the generality of the Terms & Conditions, Roamie acts solely as a technology platform and facilitator enabling users to access and book services offered by third-party service providers (“Service Providers”). Roamie does not operate, control or manage the services provided by Service Providers and shall not be liable for any act, omission, delay, cancellation, deficiency, misrepresentation, or failure on the part of any Service Provider, including but not limited to issues relating to service quality, availability, safety, refunds, cancellations, rescheduling, or statutory compliance.
11. Without prejudice to the foregoing, Roamie’s aggregate liability, if any, arising out of or in connection with any booking or use of the Platform shall, in all circumstances, be limited to the total platform fees or convenience charges actually received by Roamie from the user in respect of the relevant transaction, excluding the Base Fare paid to the Service Provider.
12. Nothing contained herein shall exclude or limit any liability that cannot be excluded or limited under applicable law, including liability arising from wilful misconduct or fraud, or mandatory consumer rights under applicable statutes.
13. Any grievance relating to cancellations or refunds may be raised through the grievance redressal mechanism provided in the Terms & Conditions. Nothing in this Policy shall restrict the rights of users under applicable consumer protection laws.
14. This Policy may be updated from time to time to reflect changes in business practices or applicable law. The updated version shall be effective from the date of publication on the Platform.
